This is pursuant to the Judiciary Act of 1948, which states that the most senior associate justice assumes the duties of the chief justice until a successor is appointed. The 90-day period to fill the vacancy begins once Gesmundo retires. The President will select the new chief justice from a list of nominees prepared by the Judicial and Bar Council (JBC).
